Initiative 24 to Fully Decriminalize Marijuana in Oregon Moves Toward Ballot

The Initiative 24 campaign is making great progress in its effort to reach the ballot. They report that so far, more than 46,000 signatures have been gathered. The campaign, run by Citizens for Sensible Law Enforcement, has until July 6 to get the required 116,283 to have its constitutional amendment placed on the November 2012 general election ballot.

Amends Constitution: Allows adult marijuana use, possession, production, except actions endangering children, public safety; state may regulate

Result of “Yes” Vote: “Yes” vote amends constitution, allows adult (21 and older) marijuana use, possession, and production; except actions that endanger children or public safety; state may regulate.

Result of “No” Vote: “No” vote retains laws prohibiting possession, manufacture, delivery of marijuana, except when used under the Oregon Medical Marijuana Act to treat a “debilitating medical condition.”

Article I of the Constitution of the State of Oregon is amended by a vote of the People to include the following new section:

Section 46.  Applicability of state laws and penalties to the private personal use, possession and production of marijuana; exceptions; statemay regulate.  Except for actions that endanger minors or public safety, neither the criminal offenses and sanctions nor the laws of civil seizure and forfeiture of this state shall apply to the private personal use, possession or production of marijuana by adults 21 years of age and older.  The State may enact laws and regulations consistent with this amendment to reasonably define, limit and regulate the use, possession, production, sale or taxation of marijuana under state law.  To allow the State time to enact laws and regulations consistent with this amendment, this amendment shall become effective in the normal course but shall not become operational until six months after its effective date.
